Nature of Indian federation

There has been a growing controversy in India regarding Union-State relations. This has been primarily due to various factors such as political differences, regional aspirations, and constitutional interpretations. The specific areas of discord include fiscal federalism, center-state relations, language issues, and the role of the Governor.

India is often described as a quasi-federal state due to its unique political structure. While it is not a federation in the strict sense, it does possess certain federal features that contribute to its decentralized governance system.

Quasi federal refers to a political system in which power is shared between a central government and regional governments, with the central government having more authority than the regional governments.

Cooperative federalism refers to a system where the central government and state governments work together in a collaborative manner to address the needs and concerns of the citizens.

The resolution of contentious issues regarding distribution of legislative powers by the courts has led to the emergence of two important principles - the Principle of Federal Supremacy and Harmonious Construction. These principles play a crucial role in maintaining the balance of power between the federal and state governments in a federal system.

The nature of federation in India has been shaped by a combination of cooperation, competition, and confrontation among the various states and the central government. In my views, these factors have played a significant role in determining the balance of power and decision-making within the Indian federal system.

The Indian constitution, while emphasizing the principles of federalism and decentralization, also exhibits centralizing tendencies to maintain the unity and integrity of the nation. This can be observed in various legislations, including the Epidemic Diseases Act, 1897; The Disaster Management Act, 2005; and the recently passed Farm Acts.
