Q 2021, Judicial Custody in India: Key Statements

With reference to India, consider the following statements:
1. Judicial custody means an accused is in the custody of the concerned magistrate and such accused is locked up in a police station, not in Jail.
2. During judicial custody, the police officer in charge of the case is not allowed to interrogate the suspect without the approval of the court.
Which of the statements given above is/are correct:

When following to the receipt of an information/complaint/report by police about a crime, an officer of police arrests the suspect involved in the crime reported, to prevent him from committing the offensive acts further, such officer brings that suspect to police station, it's called Police Custody means that police has the physical custody of the accused and he is locked up in police station.

During this detention, the police officer in charge of the case, may interrogate the suspect and this detention is not supposed to be longer than 24 hours.

Under the Article 22, an arrested person must be presented before a magistrate within 24 hours, excluding the journey time.

After the presentation if the arrest continues, the person may be remanded to Judicial Custody.

Judicial Custody means an accused is in the custody of the concerned Magistrate.

In such case a person is said to be locked up in jail. During Judicial Custody, the police officer in charge of the case is not allowed to interrogate the suspect without the permission.

'न्यायिक हिरासत'

जब किसी अपराध के बारे में पुलिस को सूचना/शिकायत/रिपोर्ट प्राप्त होती है और पुलिस का एक अधिकारी उस अपराध में शामिल संदिग्ध को गिरफ्तार करता है ताकि वह आगे अपराधी कृत्य न कर सके, तो ऐसा अधिकारी उस संदिग्ध को पुलिस स्टेशन लाता है, इसे पुलिस कस्टडी (Police Custody) कहा जाता है, जिसका मतलब है कि पुलिस के पास आरोपी की शारीरिक हिरासत होती है और उसे पुलिस स्टेशन में बंद कर दिया जाता है।

इस हिरासत के दौरान, मामले के प्रभारी पुलिस अधिकारी संदिग्ध से पूछताछ कर सकते हैं और यह हिरासत 24 घंटे से अधिक नहीं होनी चाहिए।

अनुच्छेद 22 (Article 22) के तहत, गिरफ्तार व्यक्ति को 24 घंटे के भीतर मजिस्ट्रेट के सामने पेश किया जाना चाहिए, यात्रा के समय को छोड़कर।

पेशी के बाद यदि गिरफ्तारी जारी रहती है, तो व्यक्ति को न्यायिक हिरासत (Judicial Custody) में भेजा जा सकता है।

न्यायिक हिरासत (Judicial Custody) का मतलब है कि आरोपी संबंधित मजिस्ट्रेट की हिरासत में होता है।

ऐसे मामले में व्यक्ति को जेल में बंद कहा जाता है। न्यायिक हिरासत के दौरान, मामले के प्रभारी पुलिस अधिकारी को संदिग्ध से पूछताछ करने की अनुमति नहीं होती है।
